TERMS & CONDITIONS

1. Preamble

These Terms and Conditions govern your access to and use of Dahab’s platform, including all subdomains and related services. By accessing or using the Platform, you enter into a legally binding agreement with Dahab and unconditionally accept these Terms.

If you do not agree to these Terms, you must immediately refrain from accessing or using the Platform.

These Terms must be read together with the Privacy Policy, which forms an integral part of this Agreement.

Dahab reserves the right to terminate or suspend services at any time, at its sole discretion, without liability.

2. Definitions

  • Dahab / We / Us / Our / Platform: Refers to Nub for Gold Trading LLC (Commercial Registration No. 243280), its employees and authorized agents.
  • User: Any natural or legal person using the Platform.
  • Buyer: A User initiating a purchase transaction.
  • Seller: A User listing or offering jewelry for sale.
  • Services: All services provided through the Platform.
  • Evolve Holding: Strategic partner of EGX providing official real-time gold pricing data.
  • IGI: International Gemological Institute responsible for independent inspection and verification.
  • Force Majeure: Events beyond reasonable control including natural disasters, war, governmental action, labor disputes.
  • Applicable Law: Laws of the Arab Republic of Egypt.

3. Eligibility

The Platform is strictly available to individuals aged 21 years or older. By using the Platform, you confirm you meet this requirement and have full legal capacity.

If registering as a company, you confirm you have authority to bind the entity to these Terms.

4. Accounts & Registration

To access full services, you must create an account and provide accurate information.

Natural persons must provide:

  • Full name
  • National ID
  • Address
  • Mobile number
  • Email
  • Payment details

Legal entities must provide:

  • Commercial name
  • Trade name
  • Commercial registration
  • Business address
  • Corporate email
  • Bank account details

You are solely responsible for your account activities and must maintain confidentiality of login credentials.

Dahab reserves the right to suspend or terminate accounts if information is false, incomplete, or suspicious.

Accounts are non-transferable.

5. Services Overview

Dahab provides:

  • Transparent real-time gold pricing synchronized with Evolve Holding.
  • Secure buying and selling process.
  • Mandatory jewelry inspection via IGI.
  • Free IGI inspection (conditional upon successful transaction).
  • Fund locking system ensuring secure transactions.
  • Immediate payment transfer after successful inspection.

6. Buying & Selling Mechanism

Seller Obligations:

  • Create active account.
  • Accurately list product specifications.
  • Deliver item to IGI within one (1) business day after accepting offer.

Price becomes locked upon offer acceptance and remains fixed during delivery window.

If seller fails to deliver within timeframe, transaction may be canceled.

If seller fails to retrieve item after 40 days from notification, Dahab’s liability ceases.

Buyer Obligations:

  • Register valid account.
  • Deposit Booking Security Deposit.
  • Pay remaining balance after inspection approval.

Payment remains conditional upon successful inspection and specification match.

7. Inspection & Liability

  • Minor weight variations may adjust final price.
  • Official receipt issued upon item delivery.
  • If inspection exceeds one day, receipt acts as binding guarantee.
  • If user cancels after inspection, full inspection fees become payable.
  • Specialized inspections may carry non-refundable fees.

8. Pricing & Delivery

  • Gold prices fluctuate according to Evolve Holding rates.
  • Upon offer acceptance, transaction price is locked.
  • Seller must deliver to IGI within one business day.

9. Returns & Resale Policy

All sales are final.

However, Buyer may re-list item within one (1) business day of receipt with 0% commission, provided item remains unused and in original condition.

10. Payments

Accepted payment methods:

  • E-wallets
  • Credit cards
  • Bank transfers

Dahab may modify fees and payment methods.

Dahab is not liable for third-party payment processing errors.

Users must maintain sufficient funds.

11. Platform Use Restrictions

Users may not:

  • Copy, scrape, index or extract data.
  • Reverse engineer.
  • Use automated bots.
  • Publish offensive or unlawful content.
  • Use Dahab trademarks without authorization.

12. Intellectual Property

All platform content is property of Dahab and protected by intellectual property laws.

Unauthorized use is strictly prohibited.

13. Electronic Communications

By registering, you consent to electronic communication via:

  • Email
  • SMS
  • Calls
  • Platform notifications

Electronic communications satisfy legal writing requirements.

14. Data Confidentiality

Users must maintain confidentiality of Dahab-related business information.

Dahab protects user privacy per its Privacy Policy.

15. Disclaimer of Liability

Services are provided “as is” and “as available.”

Dahab disclaims all warranties.

Dahab does not buy or sell jewelry for its own account and acts solely as intermediary.

16. Limitation of Liability

Dahab shall not be liable for:

  • Direct or indirect damages
  • Loss of data
  • Financial losses
  • Platform interruptions

Except where liability cannot legally be excluded.

17. Indemnification

Users agree to indemnify Dahab from claims, damages, legal costs arising from breach of Terms.

18. Governing Law & Jurisdiction

  • These Terms are governed by Egyptian law.
  • Exclusive jurisdiction lies with Egyptian courts.
  • Arabic version prevails in case of dispute.

19. Amendments

Dahab may amend these Terms at any time.

Continued use constitutes acceptance.
